Terms and Conditions

Welcome to Jack’s Gourmet Store. By using our website and placing an order, you agree to the following terms and the legal framework of the Republic of Singapore.

1. Contract of Sale

In accordance with the Sale of Goods Act (Cap. 393), a contract is only formed when Jack’s Gourmet Store accepts your order and sends a confirmation email. We reserve the right to decline any order due to stock unavailability, pricing errors, or delivery constraints.

2. Product Information & “Catch-Weight”

  • Weight Variations: For “catch-weight” items (e.g., steaks or whole seafood), weights listed are estimates. Final price is determined by actual weight at packing.
  • Pricing Adjustment: A variance of ±10% is considered acceptable within trade usage. If actual weight results in a significant difference, we will adjust the final bill or provide store credit.
  • Visuals: Product images are for illustrative purposes; natural variations in cut and color are expected.

3. Food Safety & “Lemon Law” Compliance

  • Satisfactory Quality: Under the Consumer Protection (Fair Trading) Act, we warrant products are fit for consumption at the point of delivery.
  • Reporting Window: Any defects must be reported within 4 hours of delivery with photographic evidence.
  • Exclusions: Due to perishability, the 6-month “Lemon Law” presumption does not apply. We are not liable for spoilage due to improper storage after receipt.

4. Delivery & Surcharges

  • Surcharges: A flat S$15 surcharge applies to Sentosa, Marina Bay Sands, and Tuas (Postal codes starting with 09, 62, 63).
  • Failed Delivery: A re-delivery fee of S$30 applies if delivery fails due to customer absence or incorrect address details.
  • Disposal Policy: Per SFA regulations, if re-delivery is impossible within the same day, perishable items will be discarded. The customer remains liable for the full cost.

5. Cancellations & Refunds

  • Perishables: No “change of mind” refunds are permitted for fresh food once processed.
  • Cancellations: Requests must be made at least 24 hours before the delivery slot.
  • Processing: Valid refunds for defective goods will be processed to the original payment method within 5–7 working days.

6. Allergens & Ready Meals

Our meals are prepared in facilities handling crustaceans, fish, nuts, dairy, and soy. While we follow SFA hygiene standards, we cannot guarantee a 100% allergen-free environment. Jack’s Gourmet Store is not liable for issues resulting from improper reheating or handling after delivery.

7. Data Protection & Governing Law

We collect and process personal data in accordance with the Personal Data Protection Act 2012. Information is used strictly for order fulfillment and delivery.

These Terms are governed by the laws of the Republic of Singapore. Disputes shall be subject to the exclusive jurisdiction of the Singapore Courts.
